How old are your vehicles ?
All our vehicles are new latest models and most under 6 months old.

What does the price include?
The price includes insurance and Vat, unlimited mileage, breakdown cover and a free 2nd driver ( Drivers 25 yrs to 75yrs old )

What driving licence do I need?
A full driving licence held for at least 2yrs. If held for only one year you may still hire a vehicle but on some occasions different rates may apply.

Where do you keep your vehicles?
We keep vehicles at most of the Major train stations throughout Cornwall and of course Newquay Airport for your ease of collection and return. Book securely on-line at most locations. Please see the list when booking.

Will you deliver the vehicle for FREE?
Delivery is Free on a Hire of 2 to 3 days or more anywhere in Cornwall subject to availability at time of booking and depending on how busy we are that day and staff availability at time of booking. Delivery is Free on any hire 1 day hire etc in the Newquay Area. i.e To a Hotel, Campsite etc in the Newquay area subject to availability at time of booking.

Will you pick up the vehicle?
Yes. If we dropped it off we'll pick it up.
We offer the facility to leave rentals at most train stations and Newquay Airport for your convenience. A one way hire between different Stations in Cornwall and Newquay Airport is possible but a supplement may apply.

What about endorsements?
If you are over 25 then you can have 2 /3 minor convictions in the last 3 years i.e 2/3 minor speeding offences / mobile phone etc 3 pts each that did not involve a disqualification. If you have been disqualified or you are not sure, please phone the office to discuss your convictions. If you are 21 to 24 years of age then no more than 3 pts in the last 3 years

How can I pay?
We accept Credit or debit cards. Please note we do not take AMERICAN EXPRESS.

Do I need to pay in advance?
If you book SECURELY on-line it is all paid for and you take advantage of a great price and the vehicle group you want, and the knowledge your booking is secure.

What are the age limits for the drivers?
Usually 25yrs to 75yrs FOR A STANDARD HIRER. AGES 21 TO 24 different rates/terms apply (typically £10.00 to £15.00 a day ) and If you are over 75 TO 79 YRS you can still hire a vehicle but the rates may vary. You need to be 25 to a 7/8/9 seater and 25yrs for certain models.

How many drivers can we have?
You get one extra driver free of charge on all hires. Any additional driver is £5.00 to £10.00 per day depending on how many days of hire it is (minimum £15.00 charge)

Can I drive a rental vehicle on a Non UK Licence?
We take the following licences as standard UK, EU and European Licences, Australia, N/zealand, Canada. Usa, S/ African And Japan other Countries not listed can usually hire as standard but sometimes different rates apply we do not take licences from certain countries as follows South America. India, Pakistan, Malasia, China, Thailand.

Do you require a Deposit?
Deposits vary and normally cover the standard Excess of £750.00.(See CDW below)

Can I pay a COLLISION DAMAGE WAIVER (CDW) to delete my excess?
A CDW Collision damage waiver can be paid locally to reduce your excess to £150.00 or Zero, depending on your vehicle, location and drop off. Typically the cost is approximately £12.00 per day.

Will I get my deposit back?
Your deposit will be refunded to you in full when you return the vehicle. If any damage has occurred while the vehicle has been in your care, the cost of the repair will be deducted from your deposit and the remaining balance refunded to you.

Can I take the vehicle abroad?
No

What happens if the vehicle breaks down?
This is unlikely, but in this event all vehicles are covered by breakdown cover whilst in your care.

TERMS AND CONDITIONS OF HIRE

IMPORTANT: Please note that the name and details supplied above must be the same as the person renting. The renter will also need to present a full, current

driving licence and the valid credit card or debit card* used to make the booking when collecting the vehicle.

 

CORNWALL CAR HIRE IS NOT OPEN 24 HRS A DAY AND SOME REQUESTS MAY BE OUT OF HOURS AT RETURN OR COLLECTION IN WHICH CASE OTHER TERMS MAY APPLY.

CORNWALL CAR HIRE WILL CONTACT YOU WITHIN 48HRS IF YOUR REQUEST IS OUT OF HOURS TO ADVISE YOU OF REVISED TERMS AND IF YOU WANT TO PROCEED.  

 

  • Cornwall Car Hire accepts most, but not all debit cards. Use of a debit card to rent a vehicle is subject to a review of your credit history or funds available. A few debit cards may not be accepted at time of rental. Qualifications & Requirements.

 

  • Approximate rental charges are based on available information at the time of reservation for renters age 25 and older. For minimum age requirements pleasesee "Rental Qualifications and Requirements" link below for details. Please note that for renters under age 25, an additional daily age differential charge may apply. Additional fees or surcharges may be applied at time of rental.

 

  • Please note that we will take as a deposit or block an amount on your credit/debit card equal to either (i) for a on-prepaid rental, the anticipated cost of the rental, or (ii) for a prepaid rental, anticipated costs of the rental, which are additional to the amount already paid.

We will require an amount on your credit/debit card equal to the sum of your hire excess typically £750.00 at collection on a UK licence and may be considerably more for Non UK licence holders (i.e £900.00 typically) and licence holders under 25 or over 75 yrs old, to cover estimated charges at the time of rental. If a CDW has been taken to reduce or lower the excess then a Pre-Authorisation deposit is taken typically for £300.00 although this can vary at the discretion of Cornwall Car Hire and may be considerably more for Non UK licence holders i.e £900.00 typically.

Please note NON UK drivers with only a Passport must provide a £900.00 security deposit on a Credit / Debit card as the theft of the vehicle is a genuine risk and a smaller deposit does not cover this risk adequately where the ID and address is not easily verified.

 

CHANGES TO RESERVATIONS

  1. Cornwall Car Hire will allow customers to make changes to a reservation:
  2. Online emailing the admin office.
  3. By calling Cornwall Car Hire. (If calling no change is confirmed unless Cornwall car hire has confirmed the change by email).
  4. No modification administration fee will be made for changes made online.

(Cornwall Car Hire reserves the right to charge an administration fee for continuous/ frequent changes).

  1. Any change made to a booking made online or through the call centre will be recalculated based on the availability and prices at the time the change is made. This may be greater or lesser than the price originally booked. This

applies to changes made to:

  1. Drop off location
  2. Pick up date and time
  3. Drop off date and time
  4. Car group
  5. Airline and flight number
  6.  SATNAV/GPS
  7. Child seats
  8. All other additional products
  9. The lead customer name and the pick up location on a reservation cannot be changed. If a customer wishes to change the lead name or the pick up location, then they must cancel the reservation (see terms and conditions for Cancellations) and make a new reservation.
  1. The customer will be asked to enter a valid CREDIT /DEBIT card number at the end of a change to a prepaid reservation. This MUST be the same credit card that wasused for the original reservation. If the customer wishes to change the credit card, then the original reservation must be cancelled (see terms and conditions for Cancellations) and a new reservation made.
  2. If no cars are available for the location and date requested, then the customer will receive an email or call or text to say : 'No cars available at this location for this date or duration'. The customer should try to change the dates or location for pick up.
  3. If no vehicles are available for the location, date or other requests made, the customer will get an email or call or text saying no availability. IF YOUR BOOKING REQUEST IS LESS THAN A MONTH BEFORE THE START OF THE RENTAL CORNWALL CAR HIRE may contact you despite the automated email confirmation to inform you of NO AVAILABILITY. If the customer sees this message, they may cancel the original reservation (see terms and conditions for Cancellations) and make a new reservation if a non prepaid or prepaid rate is available.

 

BOOKINGS ARE NOT CONFIRMED UNLESS AN EMAIL CONFIRMATION HAS BEEN SENT WITH A BOOKING /CONTRACT NUMBER.

 

  • CANCELLATIONS

 

Cancellations Due To Government And Travel Restrictions ONLY Are Valid For Either A Full Credit Note For The Cost Of The Hire To Be Deferred To A Later Date, Or A 50% Refund.

 

  1. Cornwall Car Hire will allow customers to cancel a prepaid reservation:
  2. Online by email.
  3. By calling the Office admin.
  4. A refund of the prepaid reservation will be made in full if cancelled within 24hrs of the booking being made, except where the booking cancellation is 7 days or less from the start of the booking, less an administrative fee of £30.
  5. Cancellations Less Than 7 Days Before The Start Of Hire Will Lose The Full Cost Of The Hire.
  6. Cancellations Within A Calendar Month Or Less Before The Start Of Hire Will Incur 50% Of The Cost Of The Hire.
  7. Cancellations More Than A Calendar Month Of The Start of Hire Will Get A Full Refund Minus A Minimum of £55 Admin Fee.
  8. Refunds will be made to the credit card that the original booking was made on.

 

CHANGES AT TIME OF PICK UP

  1. If at the time of vehicle collection you wish to rent a larger car or rent for a longer period, you may do so, subject to availability, on payment of additional charges. Such charges will be quoted in the currency of the UK and may be at a higher rate than those previously quoted.

 

NO SHOWS/LOST RENTALS

  1. If you fail to cancel your reservation prior to the Pick Up Time and do not collect the vehicle on the Pick Up Date, or if you fail to comply with the pick up terms (see above), we reserve the right to make a No Show/Lost RentalCharge of £70, which recovers our administration costs and compensates us for our inability to rent the vehicle when it was reserved for your use and the full cost of the rental will also be charged.
  2. We will refund your No Show/Lost Rental Charge, ifyou write to us within 14 days of the Pick Up Date at Cornwall Car Hire, Office Admin Prepayment and enclosing a copy of this Reservation Confirmation.

 

EARLY RETURN & FUEL OVERFILLS

  1. Please note that we are unable to give a refund if you return the vehicle Early or refund fuel overfills.

 

RENTAL QUALIFICATIONS

*** Renter not driving is not allowed ***

Except for when PERMISSION HAS BEEN GIVEN BY CORNWALL CAR HIRE

The person named on the reservation booking must be the main driver, present at time of rental and payer of any rental charges. An Additional driver is free if between 25 Yrs and 75 Yrs of no more than one accident or claim and no more than 2 minor traffic violations convictions in the last 3 Yrs and no disqualifications in the last 5 Yrs.

All additional drivers must present a valid driving licence and 2 additional forms of Identification dated within the last 3 months.

Each additional driver will cost £10.00 per day (subject to change) irrespective of the number of drivers up to a maximum of the number of passengers in the vehicle.

Exceptions to this fee are all contract rates, all vehicle replacement rates.

 

Minimum Age requirement is 21 Yrs, typical maximum age limit is 79 Yrs. Drivers older than 79 must be approved to drive subject to our insurance company.

Hirers of 21 years to 24 years of age and 76 to 79yrs will be subject to an additional fee of £10.00 per day (subject to change).

RENTERS WITH DISABLITIES

In each case the driver must meet the Cornwall Car Hire Rental Qualifications & Requirements and declare any disability at time of booking in the comments box and

driving is at the discretion of Cornwall Car Hire’s Insurance company who make the decision on cover available.

 

PREPAID RATES ONLY

Cornwall Car Hire applies Cancellation and No Show/Lost Rental charges on all prepaid rates booked from the following countries: Austria, Belgium, Canada, Denmark, France (including Monaco), Germany, Ireland, Italy, Luxembourg, Netherlands, Norway, Portugal, Spain (including Gibraltar), South Africa, Switzerland, Sweden, USA and the United Kingdom.

 

CHANGES AT TIME OF PICK UP

  1. If at the time of vehicle collection you wish to rent a larger car or rent for a longer period, you may do so, subject to availability, on payment of additional charges. Such charges will be quoted in the currency of the UK and may be at a higher rate than those previously quoted.

 

VEHICLE RENTAL EXTRAS

Booster seats are available to hire at £6.00 per seat per day (subject to change). 24 Hours notice is required and 48 hrs may be required at a weekend.

Child seats are available at £6.00 per seat per day (subject to change). 24 Hours notice is required and 48hrs may be required at a weekend.

 

RENTAL EXCESS AND CDW OPTION

All rentals are subject to a waivable excess ranging from GBP 750.00 to GBP 1,400.00, depending on the vehicle group, for which you are responsible in the event of damage during the rental.

You can reduce your excess liability by paying an additional daily rate called CDW (Collision damage waiver) rates are variable and can be purchased at the collection point and can be anywhere from £10.00 to £12.00 per day depending on the vehicle group but are typically £12.00 per day.

 

Collision Damage Waiver is an optional* service which, if accepted, reduces your financial liability for damage to the Cornwall Car Hire vehicle, its parts and accessories, except for theft, attempted theft or vandalism.

Tyre and windscreen cover is not included in the CDW, but additional cover for these items can be purchased separately provided the vehicle is used in accordance with the terms and conditions of the rental agreement.

*CDW may be mandatory for out of hours returns OR night time dusk collections when visibility is not great to agree the vehicle condition adequately and included in some contract or preferential rates.

 

If you choose to rely on your credit card or purchase your own CDW cover separately from CORNWALL CAR HIRE we reserve the right to charge an administration fee for requested documents in relation to the information the customer requires to settle the claim with their insurance company starting at £30.00.

We strongly recommend that you fully understand the terms and conditions of any cover provided by your credit card company before you decline any of our optional services.

 

THIRD PARTY EXCESS COVER AND INSURANCE CORNWALL CAR HIRE DOES NOT DEAL DIRECTLY AND IS NOT OBLIGATED TO DEAL WITH CUSTOMERS OWN INSURANCE COMPANY IN RELATION TO DAMAGE CLAIMS AND CDW PURCHASED SEPERATELY AND NOT FROM CORNWALL CAR HIRE.
We will deal with documentation requests from customers but please again note fees can sometimes apply depending on how much documentation is required. Parking tickets and traffic violations attract fees from various vehicle lease companies which have to be paid by Cornwall car hire and the customer is liable for these associated fees.

Transport for London (TfL) levies a Congestion Charge of GBP variable rate per day for. Full details including charges and maps can be found on the TfL Congestion Charging website at www.cclondon.com.

Hire cars are not exempt from the Congestion Charge and it is your responsibility, including visitors from abroad, and not Cornwall Car Hire to register the vehicle you are driving on a central database and to pay the charge each day you travel within the charging zone.

Cornwall Car Hire will not accept liability for these charges.

 

LICENSE REQUIREMENTS

At the time of rental, the driver must present a valid national driver's licence that has been held for at least 2 years. We accept licences from the following Nations. United Kingdom, European Union, U.S.A, Canada, Australia, New Zealand and South Africa.

Licences from other nations may be taken but this is subject to approval in advance by Cornwall Car Hire.

An International Driver's Permit (IDP) is highly recommended for non-European Union renters.

The IDP translates the national driver's licence into various languages and is not accepted without the national licence.

 

UK Licence Holders: THE CUSTOMERS DVLA LICENSE SUMMARY IS REQUIRED BEFORE COLLECTION SENT IN ADVANCE BY EMAIL AND IS MANDATORY.

 

Northern Ireland: THE CUSTOMERS NI DVLA LICENSE SUMMARY IS REQUIRED BEFORE COLLECTION SENT IN ADVANCE BY EMAIL AND IS MANDATORY

 

 

Note:

All paper driving licenses and paper counter part licenses which have been laminated will not be accepted as valid as security features cannot be seen when placed under the ultraviolet lamps at rental counters.

 

UK endorsed driver's licences:

Endorsements on licences are to be taken from date of conviction, not date of offence.

A Standard Hirer may have up to 6 penalty points on their licence in the last 3yrs for minor offences with codes SP, CU, LC, MS, MW, PC and TS.

Other conviction codes may be ok but are subject to approval in advance by Cornwall Car Hire.

Please note all disqualifications in the last 5 yrs may effect your right to hire so must be reported and approval given in advance.

Any known penalty points pending must be included in your hire declaration as a standard hirer at point of pick up. Non-declared points pending may invalidate your insurance.

You may have up to one accident or claim in the last 3 years to be a standard hirer

 

Non UK endorsed driver's licences:

A Standard hirer has no more than 2 minor offences and one accident or claim in the last 3 years

Some top of the range and prestige cars may be excluded to younger drivers and drivers with less than 5 years driving experience including MPV Hire.

We do not provide one-way hires but this is possible within Cornwall and is usually subject to a one-way surcharge, which varies.

 

Vehicles may not be taken outside of the UK.

 

The following forms of payment are accepted when booking on the websites: most

major credit cards, some debit cards.

* If you made your booking with a credit or debit card, you will need to present the card when picking-up the vehicle.

At the time of rental an authorisation or Deposit is obtained on your credit card based on the estimated rental charges, the hire excess plus the cost of one tank of fuel (Approx GBP 80.00). It varies according to the make and model of the vehicle. There must be sufficient credit on your card to cover all charges.

 

Credit cards:

Cards which carry the Electron logo or the words "Electronic use only" are not accepted.

Debit cards are accepted as a valid method of payment when you make a reservation, but only if:

- The cardholder's details on the card are embossed;

- The card carries issue and expiry dates;

- Flying "V" and floating "M" symbols are present;

- The card carries the Visa or Mastercard logo;

- The card carries the Delta logo below the Visa hologram.

Acceptable credit cards are, Mastercard, Visa, Visa Debit, Switch Maestro.

A days hire is strictly 24 hrs and hires may BE charged another days rental if vehicles are returned later than agreed without prior approval.

A charge may be levied for any impact on the following customers resulting from non or later return of a vehicle or later than agreed time which results in Cornwall Car

Hire being unable to fulfil its obligations.

Safety seats are mandatory by law in the United Kingdom for children up to 12 years old (or 1.35 metres) while travelling in motor vehicles.

Please check the government website for changes and advice and do not take Cornwall Car Hire as the definitive advisor of legal requirements on this matter and Cornwall car hire are not responsible for advising you on child seat issues only the renting of a British Standard seat .

Cornwall Car Hire offers infant seats for children for all vehicle groups:

If the seat is not returned or is returned damaged, a penalty fee will be applied as detailed above.

Infant seats can be booked via the Internet or phone with 48 hours advance notice.

 

VEHICLE RENTAL RATE QUOTES, RESERVATIONS AND PREPAYMENTS

Rate Quotes:

Vehicle rental rates vary considerably from place to place and from time to time, and they change very frequently. You may contact Cornwall Car Hire to inquire about rates for vehicle rentals through a variety of channels, including reservations telephone lines, websites and computerised reservations systems such as those utilized by travel agents. Unless it is provided in connection with certain types of reservations, a rate quote you receive is merely indicative of the rates then being offered and creates neither legal rights nor practical expectations of vehicle availability or the continued applicability of the quoted rate. Rate quotes made in connection with reservations are covered by the rules appearing below.

 

Reservations:

When you wish to make a reservation for the rental of a vehicle, you may contact Cornwall Car Hire through a variety of channels. AN ON-LINE "reservation" for a vehicle rental is a notation in Cornwall Car Hire records that you have expressed the desire and intention to rent a vehicle of a specified vehicle class from Cornwall Car Hire at a specified time, date and location (the "pick-up" time, date and location), with the vehicle to be returned to Cornwall Car Hire at a specified time, date and location (the "return" time, date and location), on the terms and conditions and subject to the rental qualifications and requirements that Cornwall Car Hire then imposes for such a rental.

 

Pick-up and return times for reservations are always expressed in local time at the pick-up and return locations, respectively.

In general, Cornwall Car Hire accepts reservations only for a class of vehicles, and not for vehicles either of specific makes, model years or models or with particular characteristics not common to all vehicles in the class.

When you seek to make a reservation, Cornwall Car Hire may decline to allow you to do so. If Cornwall Car Hire allows you to make a reservation, any legal obligations that arise – both for you and for Cornwall Car Hire or the applicable Cornwall Car Hire licensee – are discussed in detail below. The practical, non-legal significance of your making a reservation is also discussed in detail below.

 

Rental Qualifications and Requirements:

The Cornwall Car Hire Company operating a rental location at which you wish to rent or at the delivery location may impose significant qualifications and requirements on people seeking to rent vehicles. Those include the possession of a valid driver’s license, the satisfaction of minimum age requirements and the making of arrangements with respect to payment of rental charges that Cornwall Car Hire deems satisfactory. Other, significant qualifications and requirements may also apply. You must satisfy all rental qualifications and requirements at the time of pick-up; it is not sufficient for you to meet them at the time of reservation. For full details, Cornwall

Rates Quoted in connection with Reservations:

Quoted Base Rate. When you make a reservation for a rental transaction, you will generally receive a quote for the applicable base rental rate (also known as time and mileage/ kilometer charges) that, unless you are advised to the contrary, is exclusive of certain charges that may be assessed in connection with the rental, including but not limited to taxes, governmental surcharges, other surcharges, common facilities charges, drop charges, delivery and collection charges, expense reimbursements and recoveries and charges for optional products or services (such as allowing additional or younger individuals to operate the vehicle, fuel or fuel service, loss or collision damage waiver, theft protection, supplemental insurance products, child seats, ski racks, satellite radios and navigational aids). If you do not change any aspect of the reservation and the rental takes place in accordance with the reservation, then will not honor the base rate quoted. If, before the rental takes place, you change the reservation with respect to the vehicle class, pick-up time, date or location or return time, date or location, then Cornwall Car Hire reserves the right to change the base rate applicable to the rental, so long as the changed rate is disclosed to you at or before the time the rental commences.

 

Estimated Total:

When you make a reservation, in addition to being quoted a base rental rate and any estimate of the additional charges that are expected to be assessed in connection with the rental, you may receive a quote of the estimated, or approximate, total charge for the entire rental. Such a total will ordinarily be computed without regard to charges for optional products and services and charges that Cornwall Car Hire cannot, on the basis of the information available to it at the time, determine. Except in the case of prepaid rental transactions (which are discussed below), such a total will only be a good faith estimate based on tax rates and other governmentally imposed charges that Cornwall Car Hire, at the time of the quote, expects will apply at the time of the rental. If Cornwall Car Hire expectations with respect to tax rates or other govern-mentally imposed charges are not realised – for example, if tax rates are unexpectedly increased after the quote is given – then you will be liable for the taxes and other govern mentally imposed charges that actually apply at the time of rental, even if they are higher than Cornwall Car Hire had expected at the time of reservation.

 

Assumptions made in Estimates:

When it estimates additional and total charges in connection with a rate quote, Cornwall Car Hire must make assumptions. In particular, if the quoted base rental rate has a per-mile/kilometer component, then Cornwall Car Hire will compute its estimates based on assumptions regarding the distance that you will drive. Those assumptions may not reflect your driving plans, and as a result the actual costs of your rental may differ significantly from Cornwall Car Hire estimates.

 

Exception – Reservations for Distant Dates:

When you make a reservation for a rental transaction, you may be advised that the quoted rental rates for the specified pick-up time, date and place are "subject to change", "only indicative" or words of similar meaning. This typically occurs when the specified pick-up date is a number of months later than the date on which the reservation is being made. Such a reservation is called a "distant-date reservation". In the case of a distant-date reservation, Cornwall Car Hire reserves the right to change all the charges applicable to the rental, so long as the charges that will actually apply are disclosed to you at or before the time the rental commences. If you are making distant-date reservations, you may recontact Cornwall Car Hire nearer to the indicated pick-up date in order to obtain a rate quote that is not subject to the qualifications just described. The preceding four paragraphs apply only to reservations that are not distant-date reservations

 

Types of Rental Transactions and Reservations:
Cornwall Car Hire classifies rental transactions as "prepaid" and "non-prepaid". The characteristics of a "prepaid" rental transaction are described in detail below; one of the most important characteristics is that in such a transaction, you will pay some or all of the amount that will be due for the rental "up-front" (that is, shortly after you arrange for the rental). A "non-prepaid" rental transaction is any rental transaction that is not a prepaid rental transaction Cornwall Car Hire classifies reservations for rental transactions as "confirmed" or "standby". The characteristics of confirmed and "standby" reservations are described in detail below. A "confirmed" reservation is a reservation that Cornwall Car Hire makes without advising you that it is "guaranteed" or "standby". Cornwall Car Hire sometimes also takes "requests" for reservations; the characteristics of a "request" are also described below. A confirmed reservation is not confirmed until Cornwall Car Hire notifies you by email or phone or post OR TEXT advising you of such reservation and providing you the customer with a booking reference number. Prepaid rentals are standby until such action s have been made and you have been notified by Cornwall Car Hire. Until this notification the prepaid booking is known as “Standby” and is not confirmed.

 

Prepaid Rental Transactions:
When you enter into a prepaid rental transaction, you simultaneously (i) make a confirmed request for reservation with Cornwall Car Hire to rent a vehicle of a specified vehicle class from Cornwall Car Hire at a specified pick-up time, date and location, with the vehicle to be returned at a specified return time, date and location, and (ii) pay, typically by a debit, credit or charge card debit processed soon after the reservation is made, the total rental charge quoted at the time of reservation.

A prepaid rental transaction creates a two-party legal agreement between you and Cornwall Car Hire with the following terms: A. If you arrive at the specified pick-up date and location, satisfy the then-applicable rental qualifications and requirements of Cornwall Car Hire and are willing to sign the document or documents constituting the rental agreement in the form presented by, Cornwall Car Hire then Cornwall Car Hire undertakes that the Cornwall Car Hire will, within one hour of the later to occur of the specified pick-up time and your arrival at the rental counter, rent a vehicle of the specified class to you on the terms set forth in the rental agreement. The rental agreement will establish the legal obligations of you and Cornwall Car Hire with respect to the rental of the vehicle, and the legal obligations of Cornwall Car Hire with respect to the rental of the vehicle will be solely those set forth in this paragraph and paragraphs B through L below.

  1. If you rent a vehicle of the specified vehicle class from Cornwall Car Hire, abide by the terms of the rental agreement (including the obligation to return the vehicle atthe specified return location at or before the specified return date and time, in the condition required by the rental agreement), purchase no optional products or services other than those expressly to be provided under the terms of the prepaid rental  transaction and incur no additional charges (including charges for driving more thanany mileage/kilometer limit that was disclosed at the time you agreed to enter into the transaction), then the Cornwall Car Hire undertakes that it will accept the amount you previously paid as payment in full for the rental, except for taxes and other govern-mentally imposed charges applicable to the rental are different from those expected at the time of reservation.
  2. If you purchase any optional products or services that are not expressly to be provided under the terms of the prepaid rental transaction or incur any otheradditional charges (such as additional time charges if the vehicle is not returned on time, additional mileage/kilometer charges if the vehicle is driven more than a mileage/kilometer limit disclosed at the time you agreed to enter into the transaction, a service charge for failing to return the vehicle to the agreed return location or with the agreed amount of fuel in the tank, charges for loss or damage to the vehicle and charges for fines assessed against the vehicle’s owner resulting from the use of the car by you or another person with your permission), then you will be solely responsible tothe Cornwall Car Hire for the charges for such optional products or services and for such other additional charges.
  3. If you do not abide by the terms of the rental agreement or if your rented vehicle is lost, stolen or damaged, then the Cornwall Car Hire will compute the total amount due to it under the terms of the rental agreement and Cornwall Car Hire undertakes that it will to the extent permitted by law apply the amount you previously paid to Cornwall Car Hire toward the total amount due, with you being solely responsible to the Cornwall Car Hire for the balance.
  4. If you do not arrive at the specified pick-up location for the prepaid rental transaction at the scheduled pick-up time, then the reservation for the transaction will be held only until 11:59 p.m. (local time) on the specified pick-up date, unless the pick-up location closes before 11:59 p.m., in which case the reservation will be held until the closing time of the location.
  5. You may receive a complete refund from Cornwall Car Hire of the amount you previously paid to the Cornwall Car Hire in connection with a prepaid rental transaction, without any deduction for liquidated damages, if you notify Cornwall Car Hire , either through a website, by a call to Cornwall Car Hire or by a email , that you wish to cancel the transaction and Cornwall Car Hire actually receives that notice at any time during the following period (the "Free Cancellation Period 24hrs "):
  6. With respect to any prepaid rental transaction, the following shall apply: If you notify Cornwall Car Hire, either through the website, by a call to our call centreoffice or by a email, that you wish to cancel the transaction and Cornwall Car Hire actually receives that notice at any time after the end of the Free Cancellation Period and before the beginning (local time) of the specified pick-up date, then Cornwall Car Hire will promptly, at your election, either refund the amount you previously paid to Cornwall Car Hire, less liquidated damages in the amount described in the next sentence be applied toward another rental transaction involving the renter. The amount that will be payable in accordance with the preceding sentence as liquidated damages will be the amount that you were told, at the time you made the reservation, would be retained as a "Cancellation Charge" (or words of comparable meaning) if you cancelled the reservation after the end of the Free Cancellation Period. This amount, when payable, is intended to be an estimate of the amount needed to compensate Cornwall Car Hire for the administrative costs they incurred in connection with the making of the  reservation (including, without limitation, charges paid to charge, credit and debit card issuers and processors).
  7. If you do not arrive at the specified pick-up location for the prepaid rental transaction by 11:59 p.m. (local time) on the pick-up date indicated in the reservation, or by the closing time of the location on that date, if earlier, then the reservation for the transaction will expire. Amounts previously paid to Cornwall Car Hire will be lost. The amount that will be payable in accordance with the preceding sentence as liquidated damages will be the amount that you were told, at the time you made the reservation, would be retained by Cornwall Car Hire as No-Show Fee" (or words of comparable meaning). This amount, when payable, is intended to the amount needed to compensate Cornwall Car Hire for the administrative costs they incurred in connection with the making of the reservation (including, without limitation, charges paid to charge, credit and debit card issuers and processors) and for the Renting Company’s inability to rent the vehicle while it was reserved for your use.
  8. As described below under "Conditions outside the Control of Cornwall Car Hire (Force Majeur)", if, as the result of events or conditions outside the control of the Cornwall Car Hire, it is impracticable for the Cornwall Car Hire to perform its obligations under paragraph A above, then either Cornwall Car Hire may cancel the prepaid rental transaction, in which case Cornwall Car Hire will refund to you, without any deduction, the prepaid rental charge that it collected. Also, as described below under "General Conditions outside the Control of the Customer", if, as the result of general events or conditions outside your control, it is impracticable for you to perform your obligations under paragraph A above, then you will be excused from such obligations and Cornwall Car Hire will, upon receipt of notification from you of the existence of such general conditions or events, refund to you, without deduction, the prepaid rental charge that it collected from you. 
  9. Cornwall Car Hire is not responsible for consequential damages if it should fail to meet its obligations in connection with a prepaid rental transaction. Similarly, you are not responsible for consequential damages should you fail to meet your obligations in connection with the transaction.
  10. The legal rights and obligations created by a prepaid rental transaction will be governed by the laws of the jurisdiction in which the pick-up location is situated, unless applicable law mandates that a different body of law govern (in which case the mandated body of law will govern).

 

Practical Consequences of Making a Confirmed Reservation:

Although they are generally not legally obligated to do so, Cornwall Car Hire will endeavour to fulfil confirmed -prepaid rentals of vehicles, subject to (i) vehicle availability, (ii) satisfaction by renters of the relevant then-applicable rental qualifications and requirements, (iii) willingness of renters to sign the document or documents comprising the rental agreement in the form presented by the Cornwall Car Hire and (iv) in the case of standby reservations, Cornwall Car Hire’s ability to meet all confirmed reservations (as discussed above under "Standby Reservations"). Although once again they are generally not legally obligated to do so, Cornwall Car Hire will endeavour to fulfil both confirmed and standby reservations for -prepaid rentals of vehicles before offering the same vehicles for rental for the same periods to individuals who have not made reservations (sometimes called "walk-ups").

 

Expiration of Reservations:

If you make a reservation for a -prepaid rental specifying a pick-up location in and fail to arrive at the pick-up location within two hours of the specified pick-up time (or, if the location closes before then, by the location’s closing time), the reservation will expire; however, (i) if you are arriving by airplane or train etc and have provided Cornwall Car Hire with flight/arrival details details (including airline and flight number), the reservation will be held until the flight/train arrives or the pick-up location closes, whichever occurs first and (ii)if you arrive late at a location this may interfere with our delivery schedule and pre arranged commitments to other customers and on some occasions customers may have to be flexible and patient while Cornwall Car Hire does its best to full-fill its obligations to you and there may by be a delay whist Cornwall Car Hire fulfils its other obligations before you receive your vehicle.

 

Requests:

Sometimes when you seek to make a reservation, Cornwall Car Hire will advise that a reservation cannot be confirmed at that time but that a further internal query will be made to determine if it can be. When that occurs, a reservation is said to be "on request". In such a circumstance, you may be told to contact Cornwall Car Hire at a later date to determine the status of the request, or Cornwall Car Hire may undertake to contact you to advise of the status of the request. Unless and until Cornwall Car Hire subsequently advises you that a confirmed or standby reservation may now be made, all information to Cornwall Car Hire provides with respect to the requested reservation, including any associated rate quote, is merely indicative of current conditions and should not create any expectations regarding either the likelihood that a confirmed or standby reservation will eventually be available or the rate or other terms that would apply if such a reservation were eventually determined to be available.

 

Conditions outside the Control of Cornwall Car Hire (Force Majeure):

If it is impracticable for Cornwall Car Hire company to perform any of its obligations set forth in paragraph A under the heading "Prepaid Rental Transactions" at the specified pick-up time, date and location as the result of events or conditions beyond the control of Cornwall Car Hire , including, without limitation, any governmental act, flood, fire or other natural catastrophe, unusually severe weather (including wind, snow and ice storms), epidemic, Act of God, war, terrorist act, riot, insurrection, civil strife, national emergency, strike or other labour dispute, utility failure, failure or disruption of data processing or transmission or failure or disruption of access or supply, then (i) in the case of a confirmed reservation, the reservation will expire, a No-show Fee will not be charged and Cornwall Car Hire will have no further obligations with respect to the reservation and (ii) in the case of a prepaid rental transaction, the transaction will be cancelled and Cornwall Car Hire will promptly refund to you, without any deduction for liquidated damages, the prepaid rental charge that had been collected from you in respect of the transaction and the Cornwall Car Hire will have no further obligations with respect to the transaction.

 

General Conditions outside the Control of the Customer:

If it is impracticable for you to perform any of your obligations set forth in paragraph A under the heading "Prepaid Rental Transactions" at the specified pick-up time, date and location as the result of general events or conditions beyond your control, including, without limitation, any governmental act, flood, fire or other natural catastrophe, unusually severe weather (including wind, snow and ice storms), epidemic, Act of God, war, terrorist act, riot, insurrection, civil strife, national

emergency, strike or other labour dispute, utility failure, failure or disruption of data processing or transmission or failure or disruption of access or supply, then (i) in the case of a guaranteed reservation, the reservation will expire, a No-show Fee either will not be charged or will, if it was charged before you gave notice to Cornwall Car Hire of the existence of such event or condition, be promptly refunded to you and you will have no further obligations with respect to the reservation and (ii) in the case of a prepaid rental transaction, the transaction will be cancelled, and Cornwall Car Hire will promptly refund to you, without any deduction for liquidated damages, the prepaid rental charge that had been collected from you in respect of the transaction and you will have no further obligations with respect to the transaction. You should note, however, that events and conditions that are beyond your control but that are not general in nature, including, without limitation, the condition of your health and the health of those travelling with you, will not excuse your performance of your obligations under a prepaid rental transaction; Changes to travel arrangements by third parties i.e airlines and train/bus companies buses etc are not considered to be general and you should consider travel insurance or similar arrangements to protect you against unforeseen events and costs and conditions that are specific to you and those travelling with you.
